ACV Auctions ensures a robust arbitration coverage for buyers on the platform. In cases where a buyer demonstrates a pattern of consistently high claim rate on purchases, such buyers may be transitioned to a limited arbitration status on ACV Auctions. Dealers in this status will retain coverage for certain items, generally as required under NAAA, but would be restricted from opening claims for additional items.
Program Mechanics
- Dealer evaluated for the prior 3 calendar months
- Customers that exceed defined threshold will receive a notification
- Dealer will have one calendar month to reduce arbitration below threshold
- Dealers that remain above threshold will be placed will be moved to limited arbitration status
- Limited arbitration status will be in effect for a period of at least 60 days
- After the limited arbitration status period the buyer will be returned to standard arbitration status
Program Criteria
- 20+ Purchases during trailing 3 month period
- 25%+ Total Arbitration Rate during trailing 3 month period
Cure Criteria
During the one month period dealers have an opportunity to reduce arbitration rate. The criteria below trigger inclusion in the limited arbitration status.
- 25%+ Total Arbitration Rate during the cure month in question
- No purchases since notification
Definitions
- Arbitration Rate is arbitration claims opened in a month divided by gross units purchased in month
- Cure Month is the calendar month after any trailing three months where Dealer exceeds Program Criteria
Eligible Arbitral Items under Limited Arbitration Program
If a dealer is in the Limited Arbitration Buying Status, they will be strictly able to arbitrate for the following undisclosed items or defects (per most currently published NAAA policy Appendix 1):
- Fuel Conversion
- Structural Damage/Certified Structural Repair or Replacement/Structural Alteration
- Inoperative Odometer
- State-Issued VIN Plates (Including Kit Vehicles)
- Vehicles Being Sold with No Title (Bill of Sale Only)
- Logo or Decal Misrepresentation
- Fire Damage
- Biohazard Vehicles
- Stolen Vehicle/Theft Recovery (Including History)
- Flood Damage (By Auction Inspection)
- Previous Canadian Vehicles
- Total Loss and/or Salvage Retention (By Insurance Records)**
- Not Actual Miles or True Miles Unknown**
- Stolen Vehicle - Active/Open Theft **
- Lemon Law/Manufacturer's Buyback**
- Bonded, Insurance and/or Salvage Titles (Including History)**
- Grey Market Vehicles**
- Flood Damage History (Reported By Government Agencies and/or Insurance Company Records)
- Vehicles Being Sold With a Government Release for Title (27A, SF-97-1 etc.), CO, MSO, or Repo Affidavit
- Pending State or Local DMV Fees or Taxes Over $100 Due On Vehicle (If Required By Law)
- Any Disclosure Required By Law
