Arbitration: What counts as a valid disclosure?

Disclosures identify vehicle issues at the time of sale. The issues that need to be disclosed are defined by the NAAA sale light system.

Issues with valid disclosures aren't eligible for arbitration.

Channels

Valid disclosure channels are:

  • Written comments, notes, and notices.
  • Condition report selections.
  • Vehicle history and diagnostic reports.
  • Photos, videos, and audio recordings.

At physical auctions, verbal announcements made by the auctioneer, seller, or selling representative are also valid.

Accuracy

Disclosures must accurately describe the issue. They can't be ambiguous, confusing, or deceptive, which we determine on a case-by-case basis.

Disclosing dash lights and OBDII codes covers the relevant component system, even without a yellow light. If the underlying issue is outside of that system, or if the issue is severe, a yellow light is required.
